AZHIER FARHAN

Azhier Farhan bin Arisin is the founding Partner of Azhier Arisin & Co. and a law graduate with double law degrees from Universiti Teknologi MARA, Shah Alam (UiTM). He completed his Bachelor of Law (Honours) and Bachelor of Legal Studies (Honours) in second class upper. Azhier started his pupillage under Datuk Adnan Puteh Esq., the senior member of the Bar and the Managing Partner of Messrs. Adnan Puteh & Saleh. Upon successful completion of his pupillage, He was called to the Bar as Advocate and Solicitor of High Court in Sabah and Sarawak and joined Adnan Puteh & Saleh as Associate.

Within his short stint, Azhier Farhan had the privilege of appearing as counsel in the Court of Appeal and the Federal Court. He had gained extensive litigation and investigative experience in a wide range of civil and criminal cases.  He notably appeared as defence counsel for former Sabah Chief Minister Tan Sri Musa Aman in a recent election petition. His services were numerously retained by prominent politicians in the state and recently appeared for YB Yamani Hafez Musa in the apex court of Malaysia, the Federal Court.

In the past, Azhier had successfully conducted several high-profile cases involving dangerous drugs trafficking cases which carry mandatory death penalty. Azhier Farhan also handles disputes with regard to infrastructure and energy, specific recovery of moveable and immoveable property, matrimonial affairs, probate and letters of administration.

Although his area of responsibilities largely focuses in conducting civil and criminal litigation, Azhier Farhan has relative experience in handling corporate, infrastructure and energy assignments.

Azhier was previously served as the EXCO member for the Sabah Law Society, a professional statutory body established pursuant to Advocates Ordinance (Sabah Cap. 2) which governs and regulates the law profession in the state of Sabah.

Presently, Azhier sits as Non-Executive Director at Smart Sabah Corporation, a wholly-owned company of the State Government of Sabah and Executive Secretary of UMNO Sabah.

Abdul Fikry, Esq.

Abdul Fikry Jaafar bin Dato’ Abdullah

Mr. Abdul Fikry Jaafar bin Dato’ Abdullah obtained his law degree (Honours) from Multimedia University. He was admitted as Advocates and Solicitors in the High Court of Malaya in 2013 and subsequently in the High Court of Sabah and Sarawak in 2015. He then commenced practising law and gained experience at Messrs. Jumahad Julkarnain & Ahmadshah. 

Mr. Abdul Fikry is a civil and criminal litigator that had appeared in all tiers of courts. He had appeared in Federal Court as lead counsel representing Suruhanjaya Pilihan Raya (SPR) to resist an application for a stay of election in parliamentary Kimanis. He had succeeded as Appellant in the Court of Appeal pertaining to a complex power of attorney dispute and had succeeded as Respondent in another contentious land matters. 

Mr. Abdul Fikry appeared regularly in High Court trials, appeals, and hearings representing both government agencies and private companies. Among others, he had acted as counsel for Dewan Bandaraya Kota Kinabalu (DBKK) in a judicial review proceeding, representing Suruhanjaya Pilihan Raya (SPR) in four election petitions, successfully defending Sabah Economic Development Corporation (SEDCO) in a civil suit pertaining to sales & purchase agreement and successfully resisting an inter-parte injunction on behalf of a private timber company. 

 In addition to that, Mr. Abdul Fikry has extensive experience in banking litigation which includes debt recovery, foreclosure, garnishee proceeding, bankruptcy, and winding up litigation. He had represented financial institution such as Bank Islam Berhad, Sabah Credit Corporation, and Lembaga Pembiayaan Perumahan Sektor Awam (LPPSA). He also provided advisory works to government link companies such as Sabah Economic Development Corporation (SEDCO), Sabah Oil & Gas Development Corporation Sdn. Bhd (SOGDC), Sabah Land Development Board (SLDB), and Perkasa Hotel Sdn Bhd pertaining to litigation and corporate matter. 

Mr. Abdul Fikry has experience in drafting, preparing, and vetting agreements for government link company and private company which includes Joint Venture Agreement, Shareholder Agreement, Head of Agreement (HOA), Memorandum of Understanding (MOU), Sales and Purchase Agreement (SNP), Tenancy Agreement, Consultancy Agreement, and Settlement Agreement.  

Other than civil cases, Mr. Abdul Fikry also handled numerous criminal cases including drug trafficking under Section 39B of Dangerous Drugs Act, murder, criminal breach of trust, cheating, forgery, sexual offences, offences under Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act (AMLA), and offences under Commissioners for Oaths Rules 2018. Outside the office, Mr. Abdul Fikry is a car enthusiast and enjoys reading.

ARISIN ARIPIN

Arisin bin Aripin was the internal Consultant with Messrs. Azhier Arisin & Co. and a business graduate from Institut Teknologi MARA, Shah Alam (now known as Universiti Teknologi MARA). He began his career in public service at the Chief Minister’s Department in 1979 and has a total of 35 years’ standing in public service.

He had served in various state ministries and departments including as ex-officio Magistrate at Tongod and Kinabatangan Districts, Assistant District Officer, Collector of Land Revenue and Administrative Officer at Chief Minister’s Department.

At the peak of his public career, he was appointed as District Officer (DO) and Chairman of Kinabatangan District Council in Sabah. With 35 years standing in the public service, Arisin Aripin had gained extensive experience in dealing with local council’s by-laws and instruments as well as laws pertaining to land matters in Sabah.

Arisin Aripin had served as non-executive director of Megagreen Energy Sdn Bhd, a joint-venture company of FELCRA Berhad and Mega Hijau Makmur Sdn. Bhd. and Commissioner for Oaths in the district of Kinabatangan. He passed away on 17.10.2016 - Al Fatihah.
